AIRCRAFT ONLINE - Terms & Conditions

By accessing and/or or using the Aircraftonline Facility (meaning the content published on www.aircraftonline.com.au and/or on any other website or facility that links to or from the Aircraftonline facility) the User agrees to be bound by these terms and conditions of use and as amended from time to time.

About Aircraft Online
Aircraft Online [‘Aircraftonline’] is an online advertising facility created primarily for the free use of persons and corporations wishing to sell and/or buy aviation related items such as aircraft, aircraft accessories and other aviation related things.

How Can Aircraftonline Provide Free Advertising
The Aircraftonline facility is sponsored by Civil Aviation Insurance Ltd [Australia] and Civil Aviation Insurance [New Zealand] both of which are part of the Rural & General Insurance Broking Group of companies and is used primarily to advertise aviation insurance products.

Who Can Use the Aircraftonline Facility
Any person or corporation wishing to sell and/or buy aviation related items such as aircraft, aircraft accessories and other aviation related things subject to all the terms and conditions herein; in particular the User warrants that content, material and services accessed, downloaded and/or held in the User’s computer(s) is for the User’s personal use only and that the User must not without prior written permission from Aircraftonline:-

a. modify, copy, distribute, transmit, display, perform, reproduce, publish or license any material on the Aircraftonline facility;

b. use or attempt to use any material published on the Aircraftonline facility to create any website and/or other publication;

c. mirror or frame any website and/or page within the Aircraftonline facility;

d. use any automated process of any sort to query, access or copy any material on the Aircraftonline facility or generate or compile any document or database based on the material published on the Aircraftonline facility; or

e. transfer or sell any information, functionality or products or services offered on the Aircraftonline facility;

f. Aircraftonline, at its absolute discretion may cease to provide the User access to the Aircraftonline facility and/or any of its related services, without notice.

Aircraft Dealers Using Aircraftonline Facility
If you are an aircraft dealer, or a business involved with the selling of aircraft and/or aviation related items, then in addition to 'Who Can Use the Aircraftonline Facility' described above you are more than welcome to use the Aircraft Online Facilities however, you may not use the Aircraft Online facility to hawk your services to other advertisers using this website and facilities. However, where you as a dealer have a genuine enquiry regarding an advertised aircraft and/or aviation related item, you may by all means contact the advertiser. Simply put, the Aircraft Online facility is not to be used for hawking and if a dealer is found to be abusing this condition that dealer will be banned from use of the site.

Content Published on Aircraftonline for general Information Only
The content made available on the Aircraftonline facility is provided for general information only and should not be relied on as being accurate, reliable, complete or appropriate for the purposes of the User’s use of the Aircraftonline facility.

Goods and Services Provided By Third Parties
Aircraftonline does not and cannot provide any warranty in relation to any goods or services advertised for sale on the Aircraftonline facility including, but not limited to, any representation or warranty that the goods or services are of merchantable quality, fit for the purpose intended, safe for the purpose intended, as described by the seller or owned by the seller; additionally,

a. where goods and services are offered on or through the Aircraftonline facility by third parties (sellers) prices may not include government and statutory charges applicable in the jurisdiction where the goods and services are located, and/or where the buyer and/or seller are located;

b. The User is responsible for all relevant searches including, any written off register or register of security interests including in matters in relation to jurisdictional and other related matters mentioned above;

c. Aircraftonline does not act as any person(s) agent or brokerage in respect of any contract between the User and any person or; provide any warranty in relation to any persons goods or services;

d. Aircraftonline will not be responsible for the terms of any transaction between the User and any person in respect of any goods or services purchased by the User from any person using the Aircraftonline facility; nor will Aircraftonline be responsible for resolving any dispute between the User and any person in relation to such.

No Warranty as to Reliability Accuracy or Completeness of Content & Services
Aircraftonline does not warrant, represent, authorize or endorse the reliability, accuracy or completeness of any content published on the Aircraftonline facility, or on any other website or facility that links to or from the Aircraftonline facility including advertisements, products and service offers, various data, valuations, software and links supplied by advertisers and/or other third parties. Aircraftonline strongly recommends that the User checks with the seller that all information in relation to their goods and service is accurate.

Website & Electronic Viruses and Spyware
Aircraftonline does not warrant the Aircraftonline facility and/or any other website or facility that links to or from the Aircraftonline facility are free of viruses or spyware and thus, Aircraftonline does not and can not accept any responsibility and/or liability in respect to any infection, corruption of a User’s computer equipment and/or software which is damaged or destroyed as a result of an infection and/or corruption stemming from or as a result of the use of the Aircraftonline facility, including any subsequential loss thereof

Communications Services Available on the Aircraftonline Facility
The Aircraftonline facility may provide you with the ability to communicate with sellers, advertisers and Users of the Aircraftonline facility through agreements, online forms, IVR, electronic requests and enquires bulletin boards, blogs, competition entries, online forums and other forms of electronic messaging [‘Communications Services’].

The User acknowledges that communications services may be public and not private communications. Further, the User acknowledge that communication services should not be considered reviewed, screened, or approved by Aircraftonline.

Use of the Communications Services is provided on condition that the User does not do any of the following things:

a. transmit any information or material which is knowingly incorrect, misleading or deceptive;

b. transmit any defamatory, infringing, obscene, indecent or unlawful information or material or information;

c. use the communications services for any unlawful purpose;

d. post or upload files that contain software or other material or information in breach of any person's intellectual property or privacy rights;

e. upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer;

f. delete any author attributions, legal notices or proprietary designations or labels in any file that is uploaded;

g. advertise or offer to sell any goods or services, or conduct or forward surveys, contests or chain letters;

h. download any file posted by another User of the communications services that you know, or reasonably should know, is unlawful or contrary to these terms and conditions;

i. Aircraftonline may, but has no obligation to do so, review the use of the communications Services by the User and/or any person using the Aircraftonline facility; delete, edit, refuse to post or remove in whole or part any information or material uploaded or posted using the Aircraftonline facility;

In consideration for use of the Aircraftonline facility the User grants to Aircraftonline and its agents and nominees a non exclusive, payment free, perpetual, irrevocable license to reproduce, modify, delete, adapt and publish any material the User posts, uploads or otherwise transmits via the communications services and to sub-license the same for such purposes as Aircraftonline determines from time to time which includes sending the User advertising and/or information material from time to time.

Software Services
Any software, including HTML code and ActiveX controls, that is made available to download from the Aircraftonline facility ("Software") is owned or licensed Aircraftonline and/or its suppliers. The User’s use of the Software is governed by the terms of the end User license agreement, if any, which accompanies or is included with the Software ("License Agreement"). The User must agree to the terms of the License Agreement before using the Software however, where there is no License Agreement, Aircraftonline grants the User a personal, non-transferable license to use the Software for viewing and otherwise using the Aircraftonline facility and software in accordance with these terms and conditions, and for no other purpose.

The user must not:

a. copy, reproduce, translate, adapt, vary or modify in whole or in part of the Software;

b. to reverse assemble or reverse compile or directly or indirectly allow or cause a third party to reverse assemble or reverse compile, in whole or in part, the Software;

c. introduce or use any device, software or routine that interferes or attempts to interfere with the operation of the Software; or

d. sub-license, rent, lease, lend or grant to any person any rights to use the Software.

Aircraftonline is a trademark of Civil Aviation Insurance and its related bodies corporate and; material and content on the Aircraftonline facility is © [‘Copyright Material’] All rights reserved. Unless specifically otherwise indicated on the Aircraftonline facility the material on the Aircraftonline facility is owned by Aircraftonline including www.aircraftonline.com.au and other names of Aircraftonline’s products and/or services referenced herein are trademarks and/or are registered trademarks of Civil Aviation Insurance [Australia] and its owner Rural & general Insurance Broking Pty Ltd [Australia]. Other product and company names mentioned on the Aircraftonline facility may be the trademarks of their respective owners and thus, protected by copyright and trademark laws to the favour of the owners.

Email a Friend
Where Aircraftonline allows the User to email a friend via the Aircraftonline facility, the User warrants that that the person to whom the email is addressed has consented to the email being sent; and indemnify Aircraftonline, its servants and agents against all actions, claims and demands (including the cost of defending or setting any actions, claims and demands) arising out of or in respect of sending any email or any contravention of the SPAM Act 2003 and/or any other relevant laws applicable in any other jurisdictions which may apply.

What Law Governs these Terms and Conditions
This Agreement is governed by and construed in accordance with the laws of the State of New South Wales Australia in respect of Australian domiciled advertisers, and for advertisers domiciled in New Zealand, New Zealand Laws will apply. In respect of all other advertisers the laws of the State of New South Wales Australia will apply and the User irrevocably submit to the exclusive jurisdiction of the courts in that State.

Civil Aviation Insurance may cease to provide you with access to the Aircraftonline Network or any of its services without notice.

Aircraftonline May Change These Terms and Conditions
Aircraftonline may, in its absolute discretion modify or amend the terms and conditions upon which the User is granted use of the Aircraftonline facility, as described herein, which are binding upon the User once displayed on the Aircraftonline facility. Users should regularly check the terms and conditions displayed on this web site

Who Is Aircraft Online
Aircraftonline is owned by Civil Aviation Insurance [Australia] which is the aviation insurance division of Rural & General Insurance Broking Pty Ltd [Australia] a Corporation under the Australian Corporations Act. For the purposes of these terms & conditions, the term ‘Aircraftonline’ will mean the trading name of Civil Aviation Insurance’s aviation for sale website under which the Aircraftonline services are branded and is taken to mean and include Aircraftonline, its owners, officers, employees, contractors and agents, whether individually or collectively.

The User Indemnifies Aircraftonline for Their Breaches of these Terms & Conditions
The User indemnifies Aircraftonline, its owners, servants and agents against all actions, claims and demands (including the cost of defending or setting any actions, claims and demands) arising out of or in respect to their breaches of any of the terms and conditions herein.
